Abstract

The present article analyzes the perceived influence of the Brazilian legal system of environmental protection in relation to Soft Law, specifically with regard to the Stockholm Declaration, held in June 1972. The use of Soft Law as a parameter is intended to demonstrate its contribution, even while a legal instrument devoid of cogent force, for the formation of a normative system for the protection of the environment, which is a reflection of the values absorbed by the Federal Constitution of 1988. The qualitative analysis method is used, with a study of the doctrine and legislation on the process of consolidation of the human right to the environment, marked by the unique relevance of the Stockholm Declaration, to understand the dynamics of the functioning and structure of the normative system for the protection of the environment, showing the economic character that justified the appearance of the Declaration itself, and which was reflected in the Magna Carta bringing reflexes to all Brazilian normative system with the incorporation of a concept of broad development that justified the recognition of the environmental variable among those that permeate its conception.
