La première interprétation de l’article 349 TFUE par la CJUE: – clarifications et interrogations sur le statut des régions ultrapériphériques –

Abstract : The judgment in Cases C-132/14 to C-136/14 reveals in particular a conflict of the Commission and the European Parliament against the Council concerning Mayotte and the appropriate legal basis for modifying secondary legislation previously applicable. It is about the weight of the European Parliament in the decision making process regarding the Outermost Regions (ORs). Even if the legal basis of the IIIrd Part of the TFEU were pushed aside in favour of the article 349 TFEU, this article doesn't get absolute preponderance. What's more the choice of the article 349 isn't completely discretionary; it needs a very definite reason linked to the "structural social and economic situation" and the "characteristics and constraints" of the OR(s) in question. This allows a confrontation between the aim of solving those constraints (or offset them) and the chosen "specific measures". This reason is however formal and allows for the use of sectoral legal basis which may be added up.
